US Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.
The situation originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. Following his return to the United States to face human smuggling charges, he was detained in immigration custody.
In her order, the judge pointed out that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
Context of the Legal Challenge
The legal challenge center on conflicting assertions. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this claim.
He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in Tennessee.
Conditions of Freedom
The judge, who was overseeing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
This ruling marks a significant turn in a complicated immigration case featuring allegations of wrongful detention and disputed criminal associations.
